Terms of Service
These Terms of Service ("Terms") are an agreement between you and Top Velocity Performance Centers ("TopVelocity," "we," "us"), 17588 Hard Hat Dr., Covington, LA 70435. They cover topvelocity.org, the TopVelocity player portal and organization portal, our apps, online training memberships, camps, evaluations, AI training tools, coaching messages and text messages (together, the "Services"). By creating an account, buying a membership or using the Services you agree to these Terms and to our Privacy Policy.
Please read Section 15 (Dispute resolution). It requires most disputes to be resolved by individual arbitration instead of in court, and it waives class actions. You can opt out within 30 days.
1. Who can use the Services; minors and parents
- Adults (18+) may create an account for themselves.
- Athletes under 18 may use the Services only with the permission of a parent or legal guardian. When a membership is for a minor, the parent or guardian is the customer: they accept these Terms for themselves and on behalf of the athlete, they are responsible for payment, and they agree to supervise the athlete's use of the Services.
- Athletes under 13 may use the Services only after a parent or guardian has given verified consent as described in our Children's Privacy Notice. A parent can review, change or delete their child's information, and withdraw consent, at any time.
- Organizations and coaches (licensed TopVelocity Performance Centers, teams and staff using the organization portal) are also bound by their organization or license agreement. If that agreement conflicts with these Terms, the organization agreement controls for the organization.
2. Your account
Give accurate information, keep your password private, and tell us right away at info@topvelocity.org if you think someone else used your account. You are responsible for activity on your account. We may require extra sign-in protection (for example, a code sent by text or email) for staff and administrator accounts.
3. Memberships, automatic renewal and cancellation
- Automatic renewal. Online memberships are subscriptions. Unless you cancel, your membership renews automatically and your payment method is charged the plan price shown at checkout (plus any applicable tax) at the start of each billing period — monthly for monthly plans, yearly for annual plans — until you cancel.
- Free trials. If your plan starts with a free trial, your payment method is charged when the trial ends unless you cancel before then. We will tell you the trial length and the price before you sign up.
- How to cancel. Cancel any time online in your player portal (Billing → Cancel Membership), by replying to any billing email, or by emailing info@topvelocity.org. You never have to call us to cancel. Cancellation stops future renewals; you keep access until the end of the period you already paid for.
- Reminders and price changes. We email a reminder before each annual renewal, and we will give you at least 30 days' notice by email before any price increase applies to your membership. You can cancel before the new price takes effect.
- Refunds. Monthly fees are not refundable once a period starts. Annual memberships can be refunded within 30 days of purchase if you are not satisfied; after that, annual fees are not refundable. Camps, events and products follow the refund terms shown when you buy them. Where the law gives you additional refund rights, those apply.
- Pausing. Where your plan allows it, you can pause from your account; paused memberships are not charged while paused.
- Organization plans. Organizations on monthly plans and roster-spot packs are billed monthly until cancelled from the organization portal (Account → Subscription).
4. Training, health and safety — please read
Pitching, hitting, throwing programs, weighted-ball work, strength training, Olympic lifting and conditioning involve a real risk of injury, including serious arm, shoulder and elbow injuries. By using the Services you (and, for a minor, the parent or guardian) acknowledge that risk.
- Not medical advice. The Services provide general athletic training information. They are not medical care, physical therapy, athletic training services or dietetic advice, and they do not diagnose or treat any injury or condition. Talk to a physician before starting any training program, especially if the athlete has had an injury.
- Stop if it hurts. If an athlete has arm, shoulder or elbow pain, numbness, or any pain that changes how they throw, they should stop throwing and see a qualified healthcare professional before continuing. Never train through pain because a program, a coach or an AI message suggests it.
- Use good judgment. Follow age-appropriate pitch-count and rest guidelines (such as MLB/USA Baseball Pitch Smart), warm up properly, use proper equipment and supervision, and do not perform exercises you cannot do safely.
- Results vary. Velocity and performance results depend on the athlete's age, development, effort, consistency, health and many other factors. Testimonials and examples are individual results, not a promise of what any athlete will achieve.
See our AI Coaching & Health Notice for more.
5. AI tools and automated analysis
Some features use artificial intelligence, including video and movement analysis (for example MechanicsDNA and Pitch DNA), generated training programs, and the "Brent AI" assistant that answers questions in chat and by text message. AI output can be incomplete or wrong. It is a training aid, not a replacement for a qualified coach or a healthcare professional. Messages from the AI assistant are identified as AI. Do not rely on AI output for medical, safety or legal decisions.
6. Videos and other content you upload
- You keep ownership of the videos, photos and other content you upload ("Your Content"). You confirm you have the right to upload it and, for anyone shown in it, their permission (or their parent's permission for a minor).
- You give TopVelocity a non-exclusive, worldwide, royalty-free license to host, store, copy, analyze and display Your Content to provide the Services to you — for example to analyze mechanics, build your program and let your coaches review it. We do not use Your Content in our advertising or marketing without separate permission. We do not use children's videos to train AI models without the parent's separate consent.
- Do not upload content that is unlawful, infringes someone's rights, shows nudity or sexual content, harasses anyone, or contains someone else's personal information without permission. We may remove content and suspend accounts that break these rules.
- Copyright complaints: see our Copyright & DMCA Policy. We terminate repeat infringers.
7. Text messages and email
If you opt in to text messages, you agree to receive recurring automated text messages from TopVelocity (including messages written by our AI assistant) at the number you provide. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out (CANCEL, END, QUIT, UNSUBSCRIBE and REVOKE also work, and so does telling us in your own words that you want the messages to stop); reply HELP for help or email info@topvelocity.org. Carriers are not liable for delayed or undelivered messages. We do not share your mobile number or text-message opt-in data with third parties for their marketing. Marketing emails include an unsubscribe link.
8. Our content and acceptable use
The programs, videos, courses, drills, documents, software, the 3X, MechanicsDNA and TopVelocity names and logos, and everything else we provide are owned by TopVelocity or our licensors and are protected by law. Your membership gives you a personal, non-transferable, revocable license to use them for your own training while your account is active. Do not share your login, copy or resell our content, scrape the Services, reverse-engineer our software or AI tools, interfere with security features, or use the Services to harass, harm or contact minors inappropriately.
9. Organizations, coaches and safeguarding
Licensed Performance Centers and other organizations are independently owned and operated. They are responsible for their own staff, facilities, supervision, background checks and safety practices, and for complying with the law. Adults must not send private one-on-one messages to minors through the Services without including the athlete's parent or guardian, and must report any suspected abuse to law enforcement and to us at info@topvelocity.org.
10. Third-party services
We use third-party services such as Stripe (payments), Apple and Google (app stores) and our hosting, email, text-message and AI providers. Their own terms may also apply. We are not responsible for third-party websites we link to.
11. Suspension and termination
You can stop using the Services and close your account at any time. We may suspend or end access if you break these Terms, create risk for others, fail to pay, or if required by law. Sections that by their nature should survive (for example payment obligations, content licenses needed to wind down, disclaimers, limits of liability and dispute resolution) survive termination.
12. Disclaimers
Except as stated in these Terms and to the extent the law allows, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted or error-free or that any athlete will reach a particular velocity or level.
13. Limitation of liability
To the fullest extent permitted by law, TopVelocity will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data, and our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Nothing in these Terms limits or excludes liability that cannot be limited under applicable law — including, under Louisiana Civil Code article 2004, liability for physical injury, for intentional acts or for gross fault.
14. Indemnity
If you misuse the Services, upload content you don't have the right to share, or break these Terms, you agree to cover the reasonable costs, including attorney's fees, that result for TopVelocity, to the extent allowed by law.
15. Dispute resolution — arbitration and class-action waiver
- Talk to us first. Before filing a claim, email info@topvelocity.org with a description of the issue and what you want; we will try to resolve it within 60 days.
- Arbitration. If we can't resolve it, you and TopVelocity agree that any dispute arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either side may bring an individual claim in small-claims court, and either side may ask a court to stop infringement or misuse of intellectual property. The Federal Arbitration Act governs this section. For consumer claims we pay the filing and arbitrator fees beyond what you would pay to file in court.
- No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding. If 25 or more similar demands are filed by the same or coordinated counsel, they will be administered in batches as the AAA's mass-arbitration rules provide.
- Opt out. You may opt out of this Section 15 within 30 days of first accepting these Terms by emailing info@topvelocity.org with your name and the words "arbitration opt-out."
- Minors and injury claims. This section does not take away any right a minor has under the law, and it does not apply where the law does not allow it to be enforced.
16. Governing law and venue
These Terms are governed by the laws of the State of Louisiana and applicable federal law. Subject to Section 15, any court case will be brought in the state or federal courts located in St. Tammany Parish, Louisiana, unless the law of your home state gives you the right to sue where you live.
17. Changes to these Terms
We may update these Terms. If a change is material, we will tell you by email or in the Services before it takes effect. Changes do not apply to disputes already pending. If you don't agree to a change, cancel before it takes effect; continuing to use the Services means you accept it.
18. Other terms
If part of these Terms can't be enforced, the rest still applies. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor. These Terms, together with the Privacy Policy and any terms shown when you buy something, are the entire agreement between you and us about the Services.
