Privacy Policy

This Privacy Policy explains how Top Velocity Performance Centers ("TopVelocity," "we," "us"), 17588 Hard Hat Dr., Covington, LA 70435, collects, uses and shares personal information when you use topvelocity.org, the player and organization portals, our apps, camps, AI training tools, email and text messages (the "Services"). Information about children under 13 is also covered by our Children's Privacy Notice.

1. Information we collect

Account and contact information: name, email, phone number, password, mailing address, parent or guardian contact details, organization and team.
Athlete profile and training information: date of birth, height, weight, position, graduation year, throwing and hitting measurements (such as velocity and spin), workouts completed, program progress, evaluations, exam results, and sensor data from connected devices (such as ForceIQ).
Health-related answers: arm pain or soreness check-ins, injury history and recovery notes that you or a coach choose to enter so training can be adjusted safely.
Videos and photos you or your coach upload, and the body-position (pose) data our software extracts from them to analyze mechanics. We do not use facial recognition and do not create face templates to identify people.
Messages with coaches, with our support team, and with our AI training assistant in chat or by text message.
Payment information: processed by Stripe. We receive the card brand, last four digits and expiry date, not the full card number.
Device and usage information: IP address, browser and device type, pages viewed, referring links, and cookies or similar technologies (see Section 5).
Consent records: when and how you agreed to our Terms, automatic renewal, text messages and, for children, a parent's consent.

2. How we use information

To provide the Services: build and adjust training programs, analyze videos and movement, track progress, run evaluations, camps and events, and let your coaches support you.
To keep athletes safe — for example, to flag reported arm pain and recommend rest or a professional evaluation.
To process payments and manage memberships, renewals and cancellations.
To communicate with you: account and billing notices, training reminders, support replies, and (where you have agreed or the law allows) news and offers by email or text.
To secure the Services, prevent fraud and abuse, and verify sign-ins.
To improve and develop the Services, including measuring how features are used. When we use training data to improve our software, we use de-identified or aggregated data where we can. We do not use children's videos or information to train AI models without a parent's separate consent.
To comply with the law and enforce our Terms of Service.

3. How we share information

We do not sell personal information, and we do not sell or share the personal information of anyone we know is under 18 for targeted advertising. We share information only as follows:

Service providers that run parts of the Services for us under contracts that limit their use of the data to our instructions: website and database hosting, video storage, payment processing (Stripe), email delivery, text-message delivery (such as LoopMessage and Twilio and the wireless carriers), AI providers that analyze videos and draft coaching replies, analytics, and customer support tools.
Your organization and coaches. If you train with a licensed Performance Center, team or coach that uses our organization portal, they can see your profile, training data, videos and messages so they can coach you.
Parents and guardians of minor athletes, about their own child's account.
Advertising partners (adults only, with consent): if you click "Accept" on our cookie banner, Meta and Google receive information about your visits to our public website to measure and show our ads. See Section 5.
Legal and safety reasons: to comply with law or legal process, to protect the safety of any person (including reporting suspected child abuse), or to enforce our Terms.
Business transfers: as part of a merger, acquisition or sale of assets, subject to this Policy.

4. Text messages (SMS / iMessage)

If you opt in, TopVelocity sends text messages about appointments, training reminders, program updates, coaching replies from our AI training assistant (identified as AI), and offers related to our baseball and softball training programs. You can opt in by checking the unchecked consent box on our forms (for example at topvelocity.org/sms-opt-in or at signup). Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out (CANCEL, END, QUIT, UNSUBSCRIBE and REVOKE also work, and so does telling us in your own words that you want the messages to stop); you'll receive one confirmation and no further messages. Reply HELP for help or email info@topvelocity.org.

No sharing of mobile information: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent are excluded from every category of information described in this Policy and will not be shared with any third party. We share your mobile number only with the providers that technically deliver our messages, and they may not use it for their own purposes. We keep opt-out records so we can always honor STOP requests.

5. Cookies, analytics and advertising

Essential cookies keep you signed in and keep the Services secure.
Analytics (Google Analytics) measures how our website is used. You can turn it off by clicking "Decline" on our cookie banner.
Advertising (Meta Pixel, Google Ads) runs on our public website only after you click "Accept". It never runs for signed-in athletes under 18, and it does not run inside the player or organization portals or on training-video pages.
Global Privacy Control: if your browser sends a Global Privacy Control signal, we treat it as an opt-out of advertising and of any sharing for targeted advertising.
You can change your choice at any time using the "Cookie preferences" link at the bottom of our website. We do not use session-replay tools that record your keystrokes or screen.

6. How long we keep information

Account, profile and training information: while your account is active, and for up to 2 years after it closes so you can come back, unless you ask us to delete it sooner.
Videos: while your account is active; deleted on request or as part of our yearly review of closed accounts.
Children's information: see the Children's Privacy Notice — kept only as long as needed for the child's training.
Payment, tax and consent records: as long as required by law (generally up to 7 years for financial records, and at least 5 years for text-message consent and opt-out records).
Earlier AI-generated custom programs are replaced and deleted when a new one is generated.

7. Your choices and rights

You can review and update most of your information in your account. You can also ask us to access, correct, download or delete your personal information, or to stop using it for marketing, by emailing info@topvelocity.org. We will verify your request and respond within 45 days. Depending on where you live, you may have additional rights under state privacy laws, including the right to appeal our decision by replying to our response. We will not treat you differently for exercising your privacy rights. Parents and guardians can exercise these rights for their minor child.

8. Security

We use administrative, technical and physical safeguards appropriate to the information we hold, including encryption in transit, hashed passwords and session tokens, two-step verification for organization administrators, and access controls and logging. No system is perfectly secure. If a breach affects your information, we will notify you as the law requires.

9. Children and teens

Athletes under 13 may use the Services only with a parent's verified consent — see the Children's Privacy Notice. For athletes 13–17, we do not sell their information, we do not use it for targeted advertising, and privacy-protective settings apply by default.

10. Location of processing

We are based in the United States and process information in the United States. The Services are intended for users in the United States.

11. Changes to this Policy

We will post changes here with a new effective date, and tell you by email or in the Services before any material change takes effect. If a change would let us use information already collected in a materially different way, we will ask for your consent where the law requires it.
